Posting Employees to Italy– When Does the Posted Workers Directive Apply?
When sending employees abroad to work, it is always mandatory to apply for an A1 certificate. This certificate ensures the employee remains under the Danish social security system, including rights to maternity leave, unemployment benefits, sick leave, and other social protections.
What is the Posted Workers Directive (PWD)?
The Posted Workers Directive is a mandatory registration that ensures posted employees are protected by certain minimum rights in the host country. The purpose is to maintain fair competition and protect working conditions.
Through PWD, the employee is guaranteed:
- Minimum wage and overtime pay
- Rules on working hours, breaks, and rest periods
- Holiday and leave entitlements
Whether PWD registration is required depends on several factors: the type of work, the industry, duration, location, and which country benefits from the work. The requirements vary from country to country, making the registration process complex.
Short-Term Work in Italy and PWD Requirements
- For short business trips or training under 8 days, where no actual services or physical work is carried out, registration is typically not required.
- If services are performed, or if the stay exceeds 8 days, PWD registration is usually required.
How to Register in Italy
The employer must create an account as a “foreign user” in the Italian Ministry of Labour’s portal: 🔗 https://servizi.lavoro.gov.it
The following information should be prepared in advance:
- Employer’s name, VAT/CVR number, address, and contact information
- Legal representative of the employer (can reside outside Italy)
- Details of the host company in Italy
- Legal representative of the host company
- Designated record keeper and local contact person in Italy – this may be the same individual

- Employment contract or equivalent documentation
- Payslips or proof of salary
- A1 certificate (if applicable)
